Michael Kennedy, FCPA Strategic Business Advisor at Morse Group based at our Norwest practice office has marked his last day as a professional accountant on 30 June 2023. Michael started his journey in professional accounting commencing work as a graduate accountant in 1976 at then Price Waterhouse after completing a Bachelor of Commerce with Honours at the University of NSW.

After training as an auditor and completing what was then called the Professional Year Michael yearned to go back to the Country after originating off a farm from Tallimba near West Wyalong in the Central West of NSW.

Shortly thereafter Michael took a role in Dubbo working for Frank Darcy in Dubbo with a large proportion of primary production clients from the Coonamble area and other parts of Western NSW.

Just two years later Michael was Frank Darcy’s Partner and Darcy Kennedy came into being. In the ensuing 24 years Darcy Kennedy grew into an award winning team of more than 100 with 12 Partners.

After Darcy Kennedy transitioned into Investor Group now known as Findex Michael moved back to Sydney. This saw Michael as a Partner in a firm at Norwest being Macquarie Partners for 4 years and then Deloitte as a Partner for a further 4 years.

In 2016 Michael commenced at Morse Group and shortly thereafter the Norwest practice office of Morse Group was established by himself and Justin Enright. This was the Renaissance of the client facing advice facet of Michael’s career. The Norwest office has continued to be the fastest growing practice office in Morse Group since.

Michael most recently focused on advising clients (especially family groups) across Morse Group on tax and business development strategies with emphasis on the tax aspects of superannuation and self managed superannuation funds.

Value laden high quality client advice was the key driver throughout Michael’s career in professional accounting.

“I leave the profession with no regrets after a wonderful journey …not bad for a boy from Tallimba…and now finishing with 7 wonderful years at Regional firm Morse Group which is 90 years old and thriving…led by Justin Enright who worked at Darcy Kennedy as a graduate in the early 90s and is modelling his firm on the values and client service we extolled in Dubbo “said Michael Kennedy.

“There are extremely few people in the world who it can be said “do more for an organisation than what the organisation has done for them”. Michael Kennedy is one such person. He has multiple examples of the same stretching from the start of his regional career at Darcy Kennedy through to the finale at Morse Group. We at Morse Group are extremely proud of and thank Michael for all of his client service, counsel, guidance, mentoring and generosity. Testament to this is the outpouring of gratitude from a plethora of advisors who Michael has mentored over many years. We congratulate Michael on this extraordinary career and wish himself, wife Kaylene and extended family all the very best for a well earned retirement” said Justin Enright, Managing Partner of Morse Group.

Managing Partner Justin Enright reflects on the 2022 Vinnies CEO Sleepout

Well as I sit here at Norwest office the pervading thoughts to mind following last nites CEO Sleep Out in no uncertain order were…..:

            How homelessness is such a growing issue in our society and that the concept of people having a “home” is cornerstone to society;

            How it is equally about not just service delivery to the disadvantaged and those in need……it is as much about those people in a situation with a sense of hopelessness and no way out knowing that there is another human being in the world who cares about their predicament and is interested in them;

How special I think the people are who work in all manner of service delivery be it at Vinnies or other like type organisations……their dedication, desire to help and servitude to others is inspiring…

            How grateful I am for a hot shower and a hot coffee the morning after a freezing cold nite with little to no sleep;

Footnote for myself….double check I have my sleeping bag in my vehicle as well as my swag next year…..the swag in isolation is not up to it even in a warmer Sydney evening !

I arrived at White Bay yesterday in good time for registration after 5pm

We were allocated into groups of folk who were then fortunate to be able to listen at close confines to the stories of both people who have been in need of help from Vinnies and also from Vinnies volunteers on frontline food van services as well as

          case workers.

This gives rise to a cocktail of emotions - confronting, disturbing and full of hope all at once if that makes sense.

Following this session folk were then able to find a spot to put their sleeping bag and cardboard down.

As a big open waterfront area some folk opt for the protection of the overhanging awning.

Always the boy from the region myself I had to take a waterfront view…..

We then dispensed back to the main auditorium for deliveries of addresses from Vinnies Execs on how funds are disbursed and the progress of fundraising to date.

An interval then allowed for the standard issue soup and bread roll.

This was followed by more accounts from people outlaying their vulnerable stories to the audience.

I cant think of anything much more brave really than to bare all like that to a large audience.

The proceedings ended by about 10pm and it was a case of bunkering down as best as possible.

An early rise this morning of course as not really conditions for feeling like making the most of the waterfront view.

Thank you to everyone for their support and enthusiasm for my participation.

I thoroughly enjoyed it and found it renewing as always.

On Thursday 23rd June 2022, Morse Group Managing Partner Justin Enright will spend the coldest night of the year sleeping on the concrete at the White Bay Cruise Terminal in Sydney to take part in the 2022 Vinnies CEO Sleepout.

Justin is hoping to raise funds to address homelessness in our community. In more perilous times with families under economic strain due to inflation and interest rate pressure, your support for Vinnies is more important now more than ever

More than 116,000 Australians experience homelessness every night, and 32 per cent are children

. That’s not a reality Justin is comfortable with.

Avoiding Cyber Scams and Fraudulent Funds Transfers

Fraudulent Electronic Funds Transfers (EFTs) frequently cause large dollar losses. If a hacker gains control of the email of a business and a supplier of that same business (commonly referred to as a "Man in the middle" attack) and the hacker makes a fraudulent request which mimics previous legitimate requests then it is very difficult for the business to identify the request as illegitimate.

Any requests for funds to be transferred to a bank account unfamiliar to you should be a red flag, especially if that account is in another country.

If a business has a protocol with suppliers for requests for payment to be made via email then ensure you establish and follow procedures to confirm requests using a mechanism other than email and only proceed with an EFT after confirming the request is legitimate. This includes but is not limited to confirming dollar amounts, name of the financial institution and the bank account number. To validate the authenticity of the request further, confirm information only known to the supplier (to which a hacker would not know the answer).

Practical loss prevention tips to minimise potential fraudulent cyber EFT exposure include:

Basic best practice measures to reduce cyber attack risk should also include:

Fair Work has expanded compassionate leave entitlement to include miscarriage

The Fair Work Act has recently been updated to include miscarriage as a reason to access compassionate leave. Employees are now entitled to 2 days compassionate leave if they or their current spouse or de facto partner has a miscarriage.
It is important to differentiate this type of leave from Personal/Carer's leave.
Compassionate leave also gives employees time off when an immediate family or household member develops or suffers a life-threatening illness or injury or passes away. All employees are entitled to 2 days compassionate leave on each occasion it applies. It doesn't accrue. It can be taken as a single period, 2 separate days, or in any periods that the employee and employer agree on.

For full-time and part-time employees, it's 2 days paid leave. For casuals, it's unpaid.
Our HR Advisor is available to assist you in managing your employee leave obligations including:

Don’t be casual about whether you need to offer your casuals permanent employment

This week the Fair Ombudsman is reminding employers about changes to casual employment laws.
By 27 September 2021, employers (excluding small business employers of fewer than 15 employees) need to assess whether any existing casuals (employed before 27 March 2021) are eligible to be offered to convert to permanent (full-time or part-time) employment.
How do you do this?
Employers must offer existing casuals conversion to permanent employment, by 27 September, if:

They have been employed for 12 months
Worked a regular pattern of hours for last 6 months
Expect regular hours to continue permanently without significant change

Your casual employees need to respond to the casual conversion offer in writing within 21 days ie accept or continue as casual.
Employers do not have to offer casual conversion if there are reasonable business grounds not to.
Importantly: from 28 September 2021, existing casuals (who meet above criteria) can request conversion to permanent employment based on criteria above.
The bottom line is you need to first assess your casual workforce to determine if they fit into the criteria above, and then if they do, ensure you offer the option to convert to permanent employment. Employees do not have to accept the offer however employers need to demonstrate with evidence that they have made the offer.

Why it is so important to have up to date employee address and contact details

Businesses in NSW will continue to have to pivot while responding to natural disasters and worldwide pandemics. While focusing on the big picture don't lose the discipline of getting the 'small stuff' right too – it could be very costly for both you and your employees.
When was the last time you checked that you had up to date employee address and contact details? Too busy? Make the time, as the consequences can be dire and expensive.
Current Health Orders limit where your employees can travel to for work – knowing your employees home address is critical during these times. Case in point:
An essential business in Sydney unknowingly allowed a worker to attend multiple work sites while infected with COVID-19 over a period of 7 days. This worker lived in an LGA of concern and should have been directed to have a COVID test every 3 days – however home address details were not updated with the employer – so this Health Order was not followed and the person was infectious in the community for a lengthy period before showing COVID symptoms and then testing positive.
Businesses who are fortunate to still be open because they are an essential service are encouraged to provide their workers with a letter confirming they are employed in an essential role and need to travel outside of their LGA for work. This letter is evidence that your worker will need to present to the authorities to avoid a personal fine of up to $3000. How can a business meet this obligation – and how can an employee avoid a hefty fine - when address details are not up to date?
Our advice to employers is to check in at least annually with your workers to update their personal details – make the time.

Accountants and Financial Advice Constraints

Recent court cases have found instances where Accountants have over stepped the legalities of financial and investment advice.
Without the appropriate authority of a Financial Services Licence, Accountants can be unwittingly functioning outside the legal framework to be qualified to give such advice.
In this industry article by CPA Australia is commentary and guidance on "Staying in the Appropriate Advice Lane" from Fenton Green (the preferred insurance broker for CPA Australia and same for Morse Group) as well as Morse Group's Justin Enright.

We expect that all applicants for the $15,000 payment will be required to include a letter from an independent accountant showing their decline in turnover calculation in their application. We also expect that businesses not in a 'highly impacted industry' will also require an accountant's letter regardless of the payment requested ($7500 or $10,500).

Wealth Creation - Business Premises Owned By Your Self Managed Superannuation Fund

We have observed an increase in many business owners utilising their self managed superannuation fund to acquire existing business premises they currently operate from or to acquire specific purpose property to move their business operations into. This strategy may or may not involve a borrowing known as a Limited Recourse Borrowing Arrangement (LRBA). This strategy has been utilised across different industries by clients.

The advantages can include but are not limited to:

Utilising this strategy requires a business to have strict commercial arrangements in place no different to that with an unrelated third party including but not limited to:

Rental income received by a SMSF is taxed inside the SMSF at only 15% of course. This compares to a highest marginal rate of 45% plus 2% medicare levy if a property is owned by an individual. Also if a property is sold by a SMSF in accumulation phase then generally any capital gain will be subject to a 10% tax rate if it has been owned for at least 12 months. For clarity a SMSF receives a one third general discount on capital gains. If a SMSF is in pension phase when a property is sold then the tax rate can be potentially nil.

Above all else the benefits of asset protection that arise from a SMSF owning business premises can be all pervasive. When owned by a SMSF and not by a trading entity then the asset is potentially protected from claims against a trading entity provided SMSF members (that may be Directors of the trading entity) have not met a condition of release.

Superannuation Changes Post 1 July 2021

Superannuation Changes Post 1 July 2021
The superannuation landscape has been punctuated by change forever and continues to do so.
There is now an online tool launched by the government that allows individuals to rank and compare default superannuation products by fees and performance. See https://www.ato.gov.au/Calculators-and-tools/YourSuper-comparison-tool/
The performance test ranks all default MySuper products relative to a benchmark, and any product that has returned 50 points below its benchmark is considered an under performer.
From 1 November 2021 when a worker changes employment they will retain their existing super fund as a result of "stapling". The aim of the introduction of stapling is to reduce the amount of multiple superannuation accounts that an individual may have.
From 1 July 2021 there are a raft of other changes in the superannuation environment as follows:

    There is an increase in the superannuation guarantee from 9.5% to 10.0%. This will equate to an extra amount of $6.50 per week into superannuation for the average Australian. Annual increases in the superannuation guarantee will see the superannuation guarantee reach 12.0% by 1 July 2025;
    The maximum number of members in an SMSF increased from 4 to 6. This will allow for a SMSF to accumulate a larger total balance and utilise investment opportunities accordingly;
    The concessional (deductible) contributions cap increases to $27,500 from $25,000 as a result of indexation. Equally the non concessional (non deductible) contributions cap increases to $110,000 from $100,000;
The transfer balance cap being the limit on how much can be transferred into a tax free retirement account increases to $1.7M from $1.6M.
Individuals aged 65 and 66 can now make up to three years of non concessional contributions which equates to a potential maximum contribution of $330,000.

Utilising Superannuation Tax Benefits Pre 30 June 2021

Superannuation Tax Benefits Pre 30 June 2021

With 30 June 2021 on a Wednesday your super fund must receive your contribution by then to have it counted in the 2020-2021 financial year. A contribution is generally made and counted towards your contribution cap when the superannuation fund receives it. The key ingredient is ensuring enough time is allowed for the transfer of funds.

Eligibility to contribute to superannuation depends on age. Those age under 67 can contribute but if you are aged 67 to 74 you must meet a work test to contribute - which is 40 hours of gainful employment in 30 days. All is not lost if you do not meet the work test in 2020-2021 - you can still contribute under the work test exemption if you satisfied the work test in 2019-2020 and had a total superannuation balance of less than $300,000 at 30 June 2020.

Making a personal concessional contribution for which you can claim a tax deduction is straight forward as long as you contribute no more than the $25,000 cap for concessional contributions. If you also have employer contributions made for you by an employer for example then you need to be aware that they will count towards your $25,000 concessional contribution cap. You must ensure you provide your super fund with a notice of intent to claim a tax deduction and have it acknowledged by the superannuation fund trustee.

Be mindful also that you cannot create a tax loss by claiming a tax deduction for a personal contribution ie you cannot claim a tax deduction greater than the balance of your taxable income (no matter the amount of your contribution). In addition remember that a personal superannuation contribution is taxed at 15% in the superannuation fund and if your marginal rate of tax is less than or equal to this then you lose a tax benefit from making a personal contribution because of the effect of tax arbitrage. So if your taxable income for example is below the effective tax free threshold of $23,226 (after tax offsets applied) or for those eligible for the seniors and pensioners tax offset it becomes $33,898 for singles and $30,593 for each person of a couple then your tax benefit becomes nil.

If you didn't utilise the full $25,000 concessional contributions cap in the 2018/2019 and/or 2019/2020 Year's and have a total superannuation balance of less than $500,000 at 30 June 2020 then you can utilise your unused caps and contribute the same in 2021. This can be very advantageous if you have for example a capital gain that would abnormally increase your taxable income and need to mitigate this additional taxable income - a catch up contribution can serve this purpose. In another positive for planning purposes unused concessional contributions caps can be carried forward for a rolling 5 year basis.

A spouse concessional contribution will not increase your own tax deductions but will potentially reduce your tax payable. The age limit for spouse contributions has increased from 67 to 74 with the requirement that the receiving spouse must meet the work test from 67. Contributing a spouse contribution may result in a tax offset of up to $540 for a non concessional contribution to your spouses superannuation fund.

New Post
On Thursday 20 June, Managing Partner Justin Enright will spend the longest and coldest night of the year sleeping in the backyard at Morse Group Bathurst as part of the Vinnies CEO Sleepout® 2020. Why?
To raise funds to address homelessness in our community.
More than 116,000 Australians experience homelessness every night, and 32 per cent are children. That's not a reality we are comfortable with.
Help fight homelessness by donating at : the Vinnies CEO Sleepout Website here.
In uncertain times with job losses, business downturns and housing insecurity, your support is more important now than ever for Vinnies.
This year Justin is aiming to raise $5,000. This money will go towards crisis accommodation options for families and individuals at risk of homelessness, case management and counselling, educational and living skills courses, health services and home packages for those people Vinnies helps transition to housing.
To reach the fundraising goal, we need your help. Donations are tax deductible and can be processed online.
Thank you for your support.

2020 Vinnies CEO Sleepout in Bathurst

2020 Vinnies CEO Sleepout in Bathurst!
On Thursday 18 June, Justin Enright will spend the longest and coldest night of the year sleeping in the backyard at Morse Group Bathurst as part of the 2020 Vinnies CEO Sleepout®.
Why? To raise funds to address homelessness in our community.
This year the event is faced with a great challenge shared by so many people across the globe.
COVID-19 has meant this year the Vinnies CEO Sleepout transforms into an online event with participants undertaking a personalised experience. As Justin's team members often assert he has slept at the office it is only appropriate that he completes the 2020 CEO Sleepout in the backyard at 266 Howick Street Bathurst.
In uncertain times with job losses, business downturns and housing insecurity your support is more important now than ever for Vinnies.
"More than 116,000 Australians experience homelessness every night, and 32 per cent are children. That's not a reality I'm comfortable with" said Justin in advance of the CEO Sleepout.
Help Justin and Morse Group fight homelessness by donating at: https://www.ceosleepout.org.au/sponsor?kw=justin+enright
This year Justin is aiming to raise at least $5,000. This money will go towards crisis accommodation options for families and individuals at risk of homelessness, case management and counselling, educational and living skills courses, health services and home packages for those people Vinnies helps transition to housing.
Donations are tax deductible and can be processed online.
Thank you for your support. We will keep you updated on fundraising progress.

Oberon Business Awards Recognition

On the 23rd November Morse Group were Finalists in two categories at the 2018 Oberon Business Awards conducted by the Oberon Business and Tourism Association.
We were extremely pleased to win the category of Excellence in Professional Services. We have been providing accounting services to the Oberon community for generations. In 2010 we completed a move into our current premises at 99 Oberon street Oberon. The Oberon office and client base has grown significantly in that time since.
With many extremely high quality Finalists we were humbled to win this category and thank our clients, the Oberon community and our team for making this possible.

Paul Toole MP and Minister for Lands presents Justin Enright and Kira Simmons of Morse Group with the Excellence in Professional Services Award
Morse Group were also thrilled to see Kim Mawhood win the Employee of the Year category.
Kim joined Morse Group at Bathurst Office in 1996 as a Group Secretary.
When Oberon Office became a fully serviced branch office Kim took on the Accountants Assistant role. Kim has been extremely important in the growth and success of our Oberon office due to her reliability, consistency and ability to resolve all manner of client queries and issues. Kim has built up very strong client relationships in this regard.
As an indicator of the strength of Kim's win there was one Runner Up and 7 highly commended other Finalists in this category. A fantastic and thoroughly deserved recognition of Kim's consistent and high level of service over a long period of time.
We are very proud of Kim Mawhood winning this Award!
